Quiet Lapland is a subsidiary of A Frank Idea. The following terms and conditions apply to all services offered by A Frank Idea Tmi, business ID / Y-Tunnus 2955889-2. Address: PL 2208, 96201, Rovaniemi, Finland.

Definitions

A customer is a person who has ordered or in other way confirmed an activity or service to Quiet Lapland.

An order is a documentation of a booking.

An order confirmation is any documentation from Quiet Lapland to a customer including prices and specifications of the services and confirming the availability of the ordered services.

An employee is considered anybody working for Quiet Lapland, either for A Quiet Lapland directly or subcontracted as third party.

Services

Quiet Lapland offers small scale nature guided tours.

Quiet Lapland will exercise at all times measures to maintain and improve the quality of services of Quiet Lapland.

The language used for guiding and during all services is English if not otherwise stated or agreed.

The services offered and to be delivered by Quiet Lapland under these terms and conditions are set out for each service in the service descriptions at www.quietlapland.com or third party booking platforms, or otherwise agreed in written form. In case a requested and agreed upon service is not listed in the service descriptions on www.quietlapland.com or third party booking platform, an invoice may be issued and send per email by Quiet lapland.

Pricing, Reservations, Payments and invoicing policy.

The prices of the services include VAT according to the Taxation Laws and Regulations of Finland. All prices are net prices. Quiet Lapland reserves the right to change the prices in case of any unforeseen increases in costs (including but not limited to taxes, fuel prices etc.) beyond the control of Quiet Lapland.

The price for children of 7 to 14 years old is 50% of an adult price, in a rounded amount. Children under 7 years old attend the service for free.

Only persons over the age of 16 years old are allowed to use Quiet Lapland services without custody or guardianship.

Bookings of services can be made online, at the web store at www.quietlapland.com or at third party booking platforms. Credit card fees at the expense of the customer may be applied when an online payment is made.

A reservation is confirmed when the full payment for the reservation has been received on the bank account of A Frank Idea (Quiet Lapland is a subsidiary of A Frank Idea) or the full amount has been delivered to any Quiet Lapland agent, and when the booking is confirmed by a confirmation email with a confirmation number from Quiet Lapland to the customer.

The description of services on www.quietlapland.com and third party booking platform display the minimum number of customers for which the prices are calculated. In case the number of customers decreases below the stated minimum number of participating customers Quiet Lapland reserves the right to cancel or recalculate the prices for the specific service.

In case there is a short term availability for a service, customers are allowed to pay at the start of the service. In that case, the payment will be carried out through a mobile payment device by bank- or credit card, or by cash. A booking confirmed only after the total amount for the services is paid.

Different rules may be exceptionally agreed between the parties; in that case, the agreed rules must be explicitly mentioned in writing.

Cancellations and rescheduling

Quiet Lapland holds the right to accept or refuse any rescheduling request. For each rescheduling a 25€ fee per booking (not per person) will be charged to the customer, in addition to the full amount of the services.

Any cancellation or rescheduling request must be sent by e-mail to info@afrankidea.com within office hours in Finland (Mon-Fri at 10-17, EET GMT +2) including the reference of the booking number. Quiet Lapland will make all efforts possible to provide an answer per email within 24 hours.

The reservation will be totally refunded, even if the cancellation is made within 48 hours before the start of the service, if the reason for cancellation is illness. A medical certificate must be sent to info@quietlapland.com within five workdays from the date of the cancellation.

Quiet Lapland keeps a right to cancel a service if so is needed because of safety or weather conditions. In that case the full price will be fully refunded to the payer. Quiet Lapland also reserves the right to change routing of the program itself to ensure the safety or the quality of a service.

Accessible tourism: Medical conditions & customers with special needs

In case a customer has any illnesses (for example heart disease, asthma, diabetes, epilepsy, back or hip problems) or special needs that could affect somebody’s ability to take part in the services, or if she is pregnant, one should prior to participating in any services consult medical experts about ones ability to participate in the Service in question. Should the consumer have any illnesses or disability of this nature, she/he acknowledges that she/he participates in the service at her/his own risk.

Quiet Lapland has an inclusive approach in regard of service to customer with special needs. Customers who need adjusted transportation because of any illness or special need, for example because somebody uses a wheelchair, must inform Quiet Lapland two weeks prior the service.

If customers need personal assistance because of a medical condition or special need, the personal assistant(s) will participate in the service free of charge. For example, if a customer with specific needs is accompanied by an assistant, the assistant participates in the service free of charge.

If a service of Quiet Lapland extends the described duration of a service because of a medical condition or special need of a customer no additional fee shall be requested by Quiet Lapland. In case the group includes a customer with special needs, reasonable delays and longer duration of the tour can occur.

Safety

Quiet Lapland exercises at all times a pro-active approach in regards of appropriate safety- and health measures in accordance to the laws and regulations of Finland.

Customers participate at their own risk in programs and services provided by Quiet Lapland.

It is obligatory to have seat belts fastened during car transport.

Customers acknowledge that during wintertime it can be slippery outside.

Safety and other instructions by Quiet Lapland have to be followed. In case a (group of) customer(s) does not follow safety instructions, the customer(s) might be excluded from the service or the service might be terminated.

In case a customer is intoxicated because of alcohol or other substances, Quiet Lapland reserves the right to deny the intoxicated customer in a service.

Quiet Lapland does not provide outdoor clothing for the services. It is customers’ own responsibility to dress, especially their children, according to the weather in Lapland. In case a child is not suitably dressed for winter weather, a family may be refused to take part in a service.

A personal travel insurance is recommended.

Liability Insurance

Quiet Lapland, as subsidiary of A Frank Idea, has a General Third Party Liability Insurance for bodily injury and property damage according to the terms and conditions of OP Vakuutus Oy (Osuuspankki Insurance department).

Motor Liability Insurance

All the cars or other motorized transport vehicles used in traffic in Finland must have valid Motor Liability Insurance. Compensation for damages or injury resulting from a road accident shall be covered by the valid Motor Liability Insurance of the vehicle that caused the accident. Under the provisions, any customer suffering bodily injuries is entitled to receive compensation for the cost of medical treatment, pain and suffering, and handicap, in accordance with the terms and conditions of Motor Liability Insurance and laws and regulations of Finland. Compensations are based on tariffs in accordance with laws and regulations of Finland and orders of the Finnish authorities. Damages for property are by law limited up to EUR 3.300.000. But if an injured party has willfully or out of gross negligence caused his/her own injury, the injured party is not entitled to compensation.

Other Injuries

Quiet Lapland may only be held liable for personal injuries or material damage arising from accidents that have happened during the delivery of the offered services and which are caused by negligence of Quiet Lapland or its employees or sub-contractors or by the provision of faulty equipment. Quiet Lapland is not liable for any accidental damage or injury which has to be indemnified under the travel insurance of a customer.

Severability

If any part, term or provision of these terms and conditions is partly or wholly held invalid, illegal or unenforceable, the validity or enforceability of other provisions, extent part and remainder of these terms and conditions shall remain in full force and effect.

Force Majeure

Neither Quiet Lapland nor a customer shall be held liable for any default, damage or loss due to a condition force majeure or to unreasonable impairment of Quiet Lapland’s operations due to a similar cause (including but not limited to war, strike, weather, or other natural condition etc.). If encountered a force majeure condition, Quiet Lapland shall immediately notify the customer in writing thereof, and shall keep the customer fully informed of the continuation of the force majeure condition and of any relevant change of circumstances whilst such force majeure continues. When encountered a force majeure conditions Quiet Lapland shall also take all reasonable steps available to it to minimize the effects of the force majeure on the performance of their obligations under this contractual relationship.

The terms and conditions are instructed and governed by the Finnish Law. Finnish courts will have the exclusive jurisdiction to settle any claim or dispute related to such a demand. The District Court of Lapland, (in Finnish: Lapin Käräjäoikeus), placed in Rovaniemi, shall be the court of first instance.

Privacy and data protection

Quiet Lapland respects your privacy. Quiet Lapland applies best practices to ensure the safety of the digital infrastructure of Quiet Lapland.

Quiet Lapland only collects the personal data of customers that are necessary to carry out the service and ensure safety during the conduct. Personal data is used exclusively for the service and is not shared with third parties. The personal data is deleted once the service is concluded. The customer has the right to examine and correct his or her personal data.

We will never use pictures of customers taken during services of activities for promotional efforts.

Quiet Lapland is selling its services on third party booking platforms and credit card agencies. By using third party booking platforms and credit card agencies one agrees to the third party booking platform and credit card companies’ terms and agreements.

Quiet Lapland uses unencrypted email as primary medium for communication. Customers acknowledge that unencrypted email communication is not considered as secure in regards of privacy and that email communication might be intercepted. In case one prefers another medium for communication, Quiet Lapland encourages to communicate via signal messenger.

In case the website, computer or telephone of Quiet Lapland will be breached, a notification shall be put on the webpage of Quiet Lapland.

Quiet Lapland will provide a description of potential consequences and possible measures to be taken to deal with a data breach.
